Federal 25-Year Rule vs. State Registration Requirements

Japanese Kei trucks including the Honda Acty, Suzuki Carry, and Daihatsu Hijet - continue to gain popularity across the United States for agricultural use, small business applications, and quite simply, the enjoyment of ownership.

They're compact, efficient, mechanically simple, and purpose-built for utility.

However, one critical misunderstanding continues to surface in the U.S. market:

Federal import approval does not automatically mean a Kei truck is street legal in your state.

Understanding the distinction between federal import eligibility and state-level registration law is essential before purchasing.


Federal Kei Truck Import Law: The 25-Year Rule

At the federal level, vehicle importation is governed by:

  • ・National Highway Traffic Safety Administration (NHTSA)
  • ・Environmental Protection Agency (EPA)
  • ・U.S. Customs and Border Protection (CBP)

 

The 25-Year Rule Explained

Under NHTSA regulations:

  • ・Vehicles 25 years or older are exempt from Federal Motor Vehicle Safety Standards (FMVSS).

 

Under EPA regulations:

  • ・Vehicles 21 years or older, in original configuration, are generally exempt from modern emissions requirements.

Practical Effect: Most Kei trucks manufactured before 2000 may qualify for federal importation into the United States without crash testing or emissions modification.

This allows the vehicle to legally enter the country. However,

Federal eligibility governs entry. It does not determine road legality.

State Registration: A Separate Legal Framework

Street legality is determined exclusively at the state level.

Each state Department of Motor Vehicles establishes its own policies regarding:

  • ・Titling eligibility
  • ・Registration classification
  • ・Speed limitations
  • ・Highway access
  • ・Insurance requirements

 

Some states permit full on-road registration of qualifying 25-year-old Kei trucks.

Others impose restrictions such as:

  • ・Local-road-only use
  • ・Speed caps (commonly 35–55 mph)
  • ・Agricultural/off-road classification

 

Certain states require compliance standards that many Kei trucks were not originally designed to meet.
